Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you and 3C NET PVT Ltd. (“Company,” “we,” “us,” or “our”), operating as TowMyCar.uk. By accessing, registering for, or using TowMyCar.uk (the “Platform”), you (the “User”) confirm that you have read, understood, and agreed to be legally bound by these Terms and Conditions (“Agreement”).

If you do not agree to these Terms, you must not use or access our services. Your continued use of the Platform constitutes your acceptance of any updated or revised terms. TowMyCar.uk reserves the right to modify these Terms at any time at its sole discretion and without prior notice. Any such modifications shall become effective immediately upon publication on our website.

2. Definitions and Interpretation

Unless the context requires otherwise:

  • i. “Company” shall mean 3C NET PVT Ltd., a company registered in the United Kingdom under Company Registration No. 16204011.
  • ii. “Platform” shall mean the TowMyCar.uk website, mobile applications, application programming interfaces (APIs), and all related services provided by the Company.
  • iii. “Services” shall mean vehicle transportation, towing, recovery, and roadside assistance services provided through the Platform.
  • iv. “Service Provider” shall mean any independent contractor or freelancer duly registered with the Company to provide vehicle transportation services, roadside assistance (including jump-start, tyre puncture, battery breakdown services), and mobile mechanic services, among other related services.
  • v. “Customer/User” shall mean any individual or entity that requests or utilizes the Services through the Platform, whether registered or unregistered.
  • vi. “Booking” shall mean a formal request for Services submitted through the Platform by a Customer.
  • vii. “External Service Provider” shall mean any third-party vehicle recovery provider who is not registered on the Platform but whose services may be facilitated by the Company in accordance with Section 3.4 of these Terms. References in Platform communications to “independent quotes” or an “independent provider” mean quotes sourced from External Service Providers, i.e. drivers who operate off the Platform.

3. Platform Services and Limitations

3.1 Platform Role

  • The Company operates solely as a technology platform that facilitates connections between Customers and Service Providers for the provision of Services.
  • The Company does not, in any capacity, provide transportation, towing, recovery, or roadside assistance services directly.
  • The Company shall not be liable for the performance, quality, safety, legality, or timeliness of any Services provided by Service Providers, nor does it assume any responsibility for the actions, omissions, or conduct of Service Providers or Customers.

3.2 Service Provider Relationship

  • All Service Providers operate as independent contractors and not as employees, agents, or representatives of the Company.
  • The Company conducts basic credential verification, including insurance and licensing requirements. However, the Company makes no representations, warranties, or guarantees regarding the quality, safety, reliability, or performance of the Services provided by Service Providers.
  • All Service Providers are required to maintain valid and comprehensive commercial insurance coverage in accordance with applicable laws and regulations in the United Kingdom.

3.3 Service Provider Categorisation

The Company categorises registered Service Providers into the following tiers based on their level of document verification:

  • Bronze — Basic registration with minimal verification. A valid driving licence has been uploaded but further documentation may be pending review.
  • Silver — Verified driving licence and submitted basic insurance documentation, reviewed by the Company.
  • Gold — Full document verification including driving licence, commercial insurance, public liability certificate, and vehicle compliance checks.
  • Platinum — Comprehensive verification with enhanced credentials, including all Gold-tier requirements plus additional quality and compliance assessments.

Tier categorisation is provided for informational purposes only and does not constitute a guarantee, endorsement, or warranty of service quality by the Company.

3.4 External Service Providers

  • In circumstances where quotes provided by registered Platform Service Providers exceed competitive market rates, the Company may, at its sole discretion, source alternative quotes from External Service Providers who are not registered on the Platform. Such quotes are referred to in customer communications as “independent quotes”.
  • External Service Providers are not vetted, verified, or registered on the TowMyCar.uk platform. The Company does not conduct any document verification, background checks, insurance validation, or credential assessment for External Service Providers.
  • The Company accepts no responsibility or liability whatsoever for the performance, quality, safety, timeliness, conduct, or outcome of any Services provided by External Service Providers.
  • Any claims, disputes, complaints, or demands arising from or related to services performed by an External Service Provider must be addressed directly with the External Service Provider.
  • By accepting a quote from an External Service Provider facilitated through the Platform, the Customer acknowledges and accepts the associated risks.

3.5 Misuse of Platform

  • Incorrect Service Selection: If a Customer selects an incorrect service category or provides false information, the Company shall bear no liability for any disputes, cancellations, delays, or additional charges arising from such misrepresentation.
  • Prohibition of Pre-Booking Contact: Prior to the confirmation of a Booking, both Customers and Service Providers are strictly prohibited from exchanging contact information or any other means of direct communication.
  • Subcontracting Prohibition: Service Providers shall not assign, delegate, or subcontract any customer requests. Only the Service Provider confirmed by the Customer is authorized to perform the job.
  • Prohibition of Forged or Altered Documents: The Service Provider shall not submit, present, or utilize any forged, falsified, or altered documents.
  • Prohibition of Direct Solicitation: The Service Provider shall not disclose information that enables the Customer to bypass the TowMyCar.uk platform for direct business transactions.

4. Registration and Account Security

4.1 Account Requirements

  • Service Providers and Customers/Users must be at least 18 years of age to register and use the Platform.
  • Users are required to provide accurate, current, and complete information during registration and must ensure that such information remains up to date at all times.
  • Users must keep their login credentials secure and confidential. The Company shall not be liable for any unauthorized access resulting from a User's failure to safeguard their account credentials.

4.2 Service Provider Documentation

  • Service Providers are required to upload and maintain valid and up-to-date documentation, including insurance certificates, public liability certificates, and any necessary licenses.
  • If required documentation expires or undergoes changes, the Service Provider must update the relevant documents within 24 hours.
  • If a driving licence, insurance, or any other mandatory certification is suspended or revoked for any reason, the Service Provider must immediately notify the Company's administration and stop accepting jobs through the platform.
  • The Company shall not be held liable for any damages arising from a Service Provider's failure to notify the Company of expired, suspended, or revoked documentation.

5. Booking and Payment Terms

5.1 Booking Process

  • All Bookings made through the Platform are subject to Service Provider availability. The Company does not guarantee the availability of any specific Service Provider at any given time.
  • Pricing for Services is determined solely by the respective Service Provider and may vary based on location, service type, and additional requirements. The Company does not regulate or set service prices.
  • Additional charges may apply for extra services, extended waiting times, or any modifications requested by the Customer beyond the initial Booking details.

5.2 Payment Terms

  • The Customer shall pay the Service Provider directly for the Services rendered. The Company shall not be responsible for any payment disputes between Customers and Service Providers.
  • The Company shall collect a commission of fifteen percent (15%) from the Service Provider upon the Service Provider's acceptance of a Booking. This commission is charged at the time of acceptance via Stripe and is non-refundable. The Company reserves the right to modify the commission rate upon prior notice to Service Providers.
  • All payments to the Company for Services facilitated through the Platform shall be processed securely via Stripe or any other designated third-party payment processor.

5.3 Cancellation Policy

  • Customers may cancel a Booking free of charge if the cancellation request is submitted at least 12 hours prior to the scheduled service time.
  • Cancellations made after 12 hours of the scheduled service may be subject to cancellation fees as determined by the respective Service Provider's cancellation policy.
  • Operator commission refunds are governed by our Refund Policy.

6. Insurance and Liability

6.1 Insurance, Documentation and Compliance

  • Service Providers are solely responsible for maintaining valid and appropriate insurance, licences, permits, certifications, and any other documentation required by law.
  • Service Providers are strictly prohibited from accepting, bidding on, or carrying out any job through the Platform unless all required insurance, licences, and documentation are valid, current, and compliant with all applicable laws and regulations.
  • If a Service Provider's documentation expires, is suspended, revoked, cancelled, amended, or otherwise becomes invalid, the Service Provider must immediately stop accepting or carrying out jobs through the Platform and notify TowMyCar.uk without delay.
  • TowMyCar.uk does not continuously monitor or guarantee the ongoing validity of a Service Provider's insurance, licences, certificates, or other documentation.

6.2 Vehicle Roadworthiness

  • Service Providers are solely responsible for ensuring that all vehicles, recovery trucks, trailers, equipment, and accessories used to provide services are roadworthy, safe, properly maintained, and compliant with all applicable UK laws.
  • TowMyCar.uk does not inspect, certify, approve, or guarantee the roadworthiness or condition of any vehicle or equipment used by a Service Provider.
  • TowMyCar.uk shall not be responsible or liable for any accident, injury, damage, loss, claim, fine, penalty, or legal action arising from a Service Provider operating an unroadworthy, unsafe, or unsuitable vehicle or equipment.
  • The Service Provider agrees to indemnify and hold harmless TowMyCar.uk, its directors, employees, contractors, and affiliates against any claims, losses, liabilities, damages, costs, fines, or expenses arising from the Service Provider's failure to comply with these requirements.

6.3 Account Suspension and Termination

TowMyCar.uk reserves the right to suspend, restrict, or terminate a Service Provider's account immediately if the Company reasonably believes that the Service Provider does not hold valid insurance or required documentation, has provided false or outdated information, has accepted jobs without the required documents, or has failed to notify TowMyCar.uk of changes affecting their eligibility to provide services.

7. Data Protection and Privacy

The Company complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 in the collection, processing, and storage of personal data. All personal data collected through the Platform is processed in accordance with the Company's Privacy Policy. The Company implements appropriate technical and organizational security measures to protect user data from unauthorized access, loss, alteration, or disclosure.

8. Intellectual Property and Content

  • All software, designs, text, graphics, logos, icons, images, and interfaces featured on the Platform are the exclusive property of TowMyCar.uk or are licensed to TowMyCar.uk for its use.
  • Users are prohibited from copying, modifying, reproducing, distributing, or creating derivative works based on any content on the Platform without prior written permission from TowMyCar.uk.
  • By submitting any content (reviews, comments, feedback) to the Platform, Users grant TowMyCar.uk a non-exclusive, irrevocable, worldwide, royalty-free license to use, display, modify, distribute, and reproduce the content in connection with the operation of the Platform.

9. Membership and Fees

  • The first 250 Service Providers who register on the Platform shall be granted free membership.
  • Any Service Provider registering after the initial 250-member limit must pay a membership fee, the amount of which shall be determined and communicated by the Company.
  • A platform commission of fifteen percent (15%) applies to each Booking accepted by a Service Provider, charged at the time of acceptance. The Company reserves the right to modify the commission structure upon prior notice to Service Providers.

10. Dispute Resolution

  • In the event of any dispute arising under or in connection with these Terms, the dispute must first be reported to customer service for an initial resolution attempt.
  • Mediation shall be a mandatory step before any legal proceedings are initiated, and both parties agree to engage in good faith efforts to resolve the dispute through mediation.
  • These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any legal disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Termination

The Company reserves the right to:

  • Suspend or terminate any account for violations of these Terms or for any other actions deemed inappropriate by the Company.
  • Modify or discontinue any services or features of the Platform at its sole discretion, with or without notice.
  • Block access to the Platform in the event of suspicious, fraudulent, or illegal activity.
